Maine has passed a new paid sick time law for businesses with more than 10 employees that will go into effect on Jan. 1, 2021.

It’s a potentially controversial issue, one that hits small business owners particularly hard. On a personal level, no conscientious business owner wants to see their employees suffer, financially unable to take time off. Human resources departments work hard to disseminate the information that if you are sick, you ought to stay home so as not to contaminate the entire company. Other times, workers need time off to care for sick relatives, either children or aging parents, if you are in the Generation X crunch.
While the boss hates to see folks unwell, time off equates to profit loss, and that can spell disaster when you are a struggling small business operating barely in the black. - An Act Authorizing Earned Employee Leave will take effect Jan. 1, 2021 and is expected to benefit 85% of workers in the state of Maine.
- Full-time employees are entitled to earn one hour of paid leave from a single employer for every 40 hours worked, up to 40 hours in one year of employment.
- Accrual of leave begins at the start of employment, but the employer is not required to permit use of the leave before the employee has been employed by that employer for 120 days during a one-year period.
- This law will not apply to seasonal workers.
It is the first piece of legislation in the United States to allow private workers to earn paid leave time for uses other than being sick.
